High court rejects application against COP Yohuno

The High Court in Accra has dismissed an application aimed at preventing COP Christian Tetteh Yohuno from carrying out his duties as Deputy Inspector General of Police in charge of operations.

The applicant, Emmanuel Felix Amantey, a lecturer, argued that the police council and the presidency exceeded their authority by appointing COP Yohuno.

He contended that the constitution, the Ghana Police Service Act, and police service regulations do not define the role of a Deputy IGP, leading him to file a judicial review application alleging that the president and the police council acted unlawfully.

In his ruling, Justice Richard Apietu stated that the supervisory jurisdiction of the High Court was not appropriately invoked in this case.

He clarified that the court’s powers typically pertain to adjudicatory functions performed by lower adjudicating bodies, and that the President and the Police Council do not fall into that category.

Justice Apietu further asserted that the President and the Police Council were exercising administrative powers, which led to the dismissal of the application.
