President John Dramani Mahama has disclosed that a petition against Justice Yonny Kulendi did not establish a prima facie case, following advice from the Chief Justice.
According to a statement shared by Minister of State in Charge of Government Communications, Felix Kwakye Ofosu, on X (formerly Twitter) on Tuesday, December 16, 2025, the President forwarded the petition to the Chief Justice in line with Article 146 of the Constitution, which mandates that allegations against a Supreme Court justice be assessed for prima facie validity before any further action.
The Chief Justice, after reviewing the petition, wrote to the President stating that the complaint against Justice Kulendi did not meet the threshold of a prima facie case. Subsequently, the President communicated this finding to the petitioner.
This development brings clarity to the matter, confirming that the allegations against the Supreme Court judge will not proceed to formal investigation or action, as no sufficient legal basis was established.
The petitioner alleged that Justice Yonny Kulendi breached judicial ethics by engaging in matters related to the prosecution of his cousin, even though he was not directly presiding over the case.
Specifically, the complainant claimed that Justice Kulendi improperly interfered in proceedings at the High Court in the ongoing ambulance scandal trial, Republic v. Cassiel Ato Forson & 2 Others.
“This conduct contravenes several provisions of the Code of Conduct for Judges and Magistrates and has undermined public confidence in the judiciary’s integrity, impartiality, and independence—the very principles on which our justice system is founded,” the petition stated.
