Supreme court dismisses lawsuit against office of the special prosecutor

The Supreme Court has dismissed a lawsuit filed by Kenneth Kwabena Agyei Kuranchie, Editor-in-Chief of the Daily Searchlight Newspaper, challenging the constitutionality of the Office of the Special Prosecutor (OSP).

Kuranchie’s legal action sought to declare the Special Prosecutor Act, 2017 (ACT 957) as unconstitutional, alleging violations of several articles of the 1992 Constitution.

The OSP was established to investigate specific allegations of corruption and corruption-related offenses involving public officers, politically exposed persons, and individuals in the private sector.

Despite filing a similar case last year, which he later discontinued, Kuranchie recently filed a new case.

However, the Supreme Court dismissed the initial case, emphasizing that the OSP should not be burdened with such lawsuits and should focus on its duties.

Following discussions on the notice of discontinuance, the court’s decision effectively rendered Kuranchie’s new filing redundant.

The dismissal of the case indicates that the Supreme Court has upheld the constitutionality of the OSP and its enabling act, allowing the office to continue its work investigating corruption allegations.
