Supreme court overturns re-collated results for Okaikwei central, Tema central, and two other constituencies

The Supreme Court has annulled the re-collated parliamentary election results for Okaikwei Central, Ablekuma North, Tema Central, and Techiman South, effectively overturning the Electoral Commission’s (EC) declarations for these constituencies.

This ruling comes amid ongoing legal and political disputes surrounding the re-collation process.

However, the court upheld the re-collated results for Nsawam Adoagyiri and Ahafo Ano South West, leaving the outcomes for these constituencies unchanged.

This landmark decision underscores the judiciary’s role in addressing electoral irregularities and ensuring adherence to constitutional and procedural standards.

The ruling follows a legal challenge by the National Democratic Congress (NDC) against a controversial High Court order from December 20, which instructed the EC to re-collate results in nine disputed constituencies.

While the EC has completed the re-collation in seven constituencies, all won by New Patriotic Party (NPP) candidates, results for Dome/Kwabenya and Ablekuma North remain pending.

The NDC has strongly opposed the re-collation process, arguing that it was unlawful and flawed. The party claims the High Court exceeded its jurisdiction, jeopardizing the transparency and integrity of the electoral process.

This decision is expected to have significant political consequences as stakeholders and constituents await the next steps.

Delivering the ruling in Accra on Friday, Justice Gabriel Pwamang, presiding judge noted that “Since the orders which have been brought to be quashed are separate and distinct we have decided to exercise our discretionary power to quash by certiorari having required to the peculiar circumstances of each ruling.

“Consequently, we hereby quash the orders of mandamus made for collation of results by the EC in the following constituencies Okawkwei Central, Ablekuma North, Tema Central and Techiman South.”
